Japan's Koseki System Creates Problems for LGBTQ+ Families

Japan's traditional koseki family registration system does not recognize same-sex couples or LGBTQ+ families. Activists are pushing for reform, but the government is slow to make changes.

Japan has an old family registration system. It is called the koseki system. This system records all family members officially. But it causes big problems for LGBTQ+ people.

The koseki system only recognizes traditional families. A traditional family has a married man and woman. Same-sex couples are not recognized. This makes life very hard for LGBTQ+ families in Japan.

The system controls many important things in life. It affects inheritance rights. It affects parental rights too. LGBTQ+ couples cannot register their children together. This means one parent has no legal rights over their child.

Japan does not allow same-sex marriage nationally. Some cities offer partnership certificates. But these certificates are not the same as marriage. They do not give full legal rights. The koseki system still does not recognize same-sex couples.

LGBTQ+ activists have been fighting for change. They say the koseki system is outdated. It does not reflect modern Japanese society. Many young Japanese people support same-sex marriage. But the government moves very slowly on this issue.

The rigid rules of the koseki system hurt transgender people too. Transgender individuals must meet strict requirements to change their gender. They must have surgery first. They must also be unmarried and have no children. These rules are very difficult to follow. Many transgender people cannot change their legal gender because of this.

Japan's Supreme Court has looked at these issues. In 2023, the court ruled some transgender rules were unconstitutional. This was a small but important step forward. Activists hope for more legal changes soon.

Other Asian countries are slowly changing their laws. Taiwan already allows same-sex marriage. Thailand recently made progress too. Japan feels pressure to modernize its family laws. But the conservative government resists big changes.

LGBTQ+ families in Japan continue to live without full legal protection. The koseki system remains a major barrier. Activists say real equality needs a complete reform of this system. They will keep fighting until every family is recognized equally under Japanese law.
