Germany is debating the new Self-Determination Act. In German it is called 'Selbstbestimmungsgesetz', or SBGG. This law makes it easier for people to officially change their gender.

Three states are concerned about the law. Saxony, Saxony-Anhalt and Thuringia want to introduce a so-called 'plausibility check'. They aim to prevent 'obvious misuse' of the law. This means authorities would verify proper use of the law.

Critics disagree strongly with this approach. They say such checks harm trans people. Trans people would have to prove their identity again. Many find this an invasion of privacy and dignity.

The three states have conservative political majorities. They worry people might misuse the law. For example, to gain advantages in sports or women's prisons. Experts say such misuse is extremely rare in practice.

Hamburg is taking a different approach. This city-state wants to recognize historical suffering of trans and intersex people. Previous laws were very strict and humiliating. Trans people had to undergo mandatory operations to change their gender. Hamburg wants to officially acknowledge and address this historical harm.

The Self-Determination Act was introduced in 2024 by the German government. It replaces an old, strict law from 1980. Now people can change their gender and first name themselves. No court or medical evidence is needed.

The debate shows how divided Germany is on trans rights. Some states want to ease the law and recognize victims. Other states want more control and restrictions instead.

LGBTIQ+ organizations are watching developments closely. They warn that extra checks make trans people vulnerable again. So the struggle for equal rights in Germany continues.
